The Antioch University Central Administration, located in Yellow Springs, Ohio, filed motion for dismissal.
YELLOW SPRINGS, OH – March 14, 2008 – Attorneys for Antioch University central administration have today filed a motion to dismiss the lawsuit filed by 17 members of the Antioch College faculty on Tuesday. Antioch College, a undergraduate residential college, is a part of the Antioch University system and the campus is located in Yellow Springs, Ohio.
It is the University's position in the motion that the lawsuit is completely without merit and has been filed as a tactic to pressure the University into entering into an agreement with the Antioch College Continuation Corporation to sell the College. The University intends to vigorously defend the lawsuit. While negotiations with AC3 are continuing, the Board will not be distracted from its fiduciary obligations by baseless lawsuits. This is essentially the same lawsuit that was voluntarily dismissed by the faculty in November on the eve of a decision by the Court of Common Pleas in Greene County regarding the University's motion to dismiss that suit.
The University has also filed a motion to stay any discovery in the lawsuit until after the court has ruled on the motion to dismiss. Plaintiffs have asked to take depositions of key University officers and board members next week. Yet, it is clear from public comments that the depositions and other discovery are merely ploys to put additional pressure on the University board. It is the University's position that such tactics are an abuse of the judicial process. The University has asked that the court stay any such discovery.
As with all recent developments at Antioch College, this recent action does not affect Antioch University Los Angeles or any of the other Antioch University non-residential campuses located in Yellow Springs, OH (McGregor); Keene, NH; Santa Barbara, CA; and Seattle, WA or its national PhD program in Leadership and Change – all of which are strong and growing. Antioch University Los Angeles will continue to operate with no interruption.
